LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE OR INTERFERE WITH THE OPERATION OF THE CONTEST, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. PAT & OSCAR’S RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
NO PURCHASE OR CONTRIBUTION NECESSARY TO ENTER OR WIN. A PURCHASE OR CONTRIBUTION WILL NOT IMPROVE YOUR CHANCES OF WINNING.
The Pat & Oscar’s Aflac All-American Experience is open to legal residents of California. Participants under the age of 13 years old must have their parents’ permission to enter.  The Contest nomination period begins at 12:01 a.m. Pacific Standard Time (PT) on July 15, 2010 and ends at 11:59 p.m. (PT) on August 8, 2010. Winners will be selected and notified by August 9, 2010.

1. Description of the Contest:  The Pat & Oscar’s Aflac All-American Experience Contest is designed to encourage participants to enter for a chance to win an All-American baseball experience at the 2010 Aflac All-American game at Petco Park. Winner will be randomly selected to and will be given VIP treatment at the event.

1. How to enter: Visit www.aflacallamerican.com/entertowin.asp and follow all entry instructions and submit information as directed.  Online entries must be received by 11:59 p.m. (PT) on August 8, 2010. Online entrants subject to all notices posted online including but not limited to privacy policy. Limit: one online entry per person.   All entries and requests become property of Pat & Oscar’s and is not responsible for lost, late, damaged or misdirected entries.  In fairness to all, Pat & Oscar’s cannot discuss the contest by phone, mail or in any other way with the contestants.

It is the sole responsibility of each participant to maintain his/her registration and contact information current; and Pat & Oscar’s will have no responsibility or liability for a participant’s failure to do so.
Employees of Pat & Oscar’s, and their parent company, affiliates, subsidiaries, advertising and promotion agencies (collectively, “Promotion Partners”), and the immediate families of each are not eligible to enter or win. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Pat & Oscar’s in connection with the Contest, shall be governed by, and construed in accordance with all federal, state and local laws. Void where prohibited by law. 

1. PRIZE: Two (2) pairs of winners will be selected to receive attendance to the 2010 Aflac All-American Baseball Classic Awards Banquet presented by Pat & Oscars with players and coaches. Winners will also receive VIP access to Petco Park before the venue opens, with preferred parking the day of the event. In addition winners will attend a pre-game meal in the clubhouse before the game with he All-American players. Finally, winners will have field access and seats in the dugout for the homerun derby and the 2010 Aflac All-American game. Pat & Oscar’s is not responsible for lost or stolen prizes. Odds of winning depend on the number of eligible entries. Non refundable or exchangeable. Cash substitutions are not permitted. Pat & Oscar’s makes no warranty with respect to any prize and reserves the right to substitute a prize of equal of greater value, the right to change, modify, or extend contest dates if it should be deemed necessary.
2. WINNER: Two (2) pairs of winners will be randomly selected based on submissions between 12:01 a.m. July 15th through 11:59 p.m. on August 8, 2010. Winners will be notified by email by August 9, 2010.  Three attempts will be made to contact the potential winner via email within a forty eight (48) hour period. If the potential winner fails to respond within the forty eight (48) hour period, or if the email attempt is consistently returned as undeliverable, the potential winner will be disqualified and an alternate winner may be selected at the sole discretion of Pat & Oscar’s. When the potential winner acknowledges receipt of notification email, he or she will be notified via email regarding his or her prize, and will be required to complete and return an Affidavit of Eligibility/Release of Liability and a Publicity Release (“Affidavit/Release”) within five (5) days from mail date specified on notification. If Pat & Oscar’s is unable to contact the winner to notify such winner of his or her winning status, or if prize notification is returned as undeliverable, the prize will be forfeited and at the sole discretion of the Pat & Oscar’s, the prize may be awarded to an alternate winner. Failure to return executed Affidavit/Release within the time allocated will result in disqualification and an alternate winner may be selected. If Affidavit/Release is returned as undeliverable, or if the selected winner cannot accept the prize for any reason, and there is sufficient time, the prize may be awarded to an alternate winner in a separate random drawing. If this is the case, at Pat & Oscar’s sole discretion, it may award the prize to alternate winner to an alternate destination. Acceptance of a prize constitutes permission (except where prohibited by law, as for a minor under 13 years of age) for Pat & Oscar’s to use winner's name, prize won, hometown and likeness for purposes of advertising, promotion, publicity and online posting without additional compensation, review, or approval.

By participating, entrants agree to these Official Rules and the decisions of Pat & Oscar’s, and release the Pat & Oscar’s and parent companies, affiliates, subsidiaries, distributors, retailers, advertising and promotion agencies, and the officers, directors, employees, shareholders and agents of each of the foregoing from any and all claims or liability relating to their participation and/or any prize awarded, including, without limitation, any travel or activities associated with the prize.

PRIVACY NOTICE: Pat & Oscar’s collects personal data when you register for (and participate in) this Promotion.  Registration for the Promotion constitutes your permission for the Pat & Oscar’s and the Promotion Administrator to maintain the data in the United States. The data is collected to maintain a record of those who have registered for and participated in the Promotion, to contact potential winners and, in the case of U.S. residents only, for marketing purposes in accordance with Pat & Oscar’s’s privacy policy located at www.patandoscars.com
2. OTHER CONDITIONS: Pat & Oscar’s assumes no responsibility for computer system, phone line, hardware, software or program malfunctions or other errors, failures of any kinds, delayed computer transmissions or network connections that are human or technical in nature. Pat & Oscar’s  reserves the right in its sole discretion to cancel or suspend this contest, in its entirety or in part should virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond the Pat & Oscar’s control corrupt the administration, security, fairness, integrity or proper play of the sweepstakes. Pat & Oscar’s is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the contest by any technical or human errors, which may occur in the processing of the entries in the contest. Pat & Oscar’s reserves the right to withdraw the transmission of this sweepstakes at any time and award the prize from among eligible entries received prior to the date of the withdrawal. Pat & Oscar’s reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the game or web-site or to be acting in violation of the official rules. Not redeemable for cash.
3. Pat & Oscar’s COPPA Compliance: A child under 13 can participate only if the parent or legal guardian grants their consent to participate in the contest.  All personal information about the child collected from the website entry form will be collected only with parental consent. Personal contact information collected from the child including email address will only be used to notify contest winners and will not be posted on our website or used for any marketing activity. We will not disclose any personal information to third parties.  All personal information is used only internally by Pat & Oscar’s and will not be used after the contest ends. In the case a child has provided us with personal information without parental or guardian consent, please contact us directly to request removal of the child’s entry and contact information.
